„Spioonide sild“, altkäemaks ja toimingupiirangud Eesti Vabariigis (osa 2)

Vandeadvokaat Olev Kuklase arutleb toimingupiirangute ja õigusriigi üle Eesti Vabariigis. Postitus on jagatud kolmeks osas. Kui Teil jäi lugemata osa 1, siis see on kättesaadav SIIN.

„Õigusriiklik õigusemõistmine? Ette nägemine?“

 

Tulles tagasi filmi „Spioonide sild“ juurde, siis seal suudab advokaat J.Donovan oma kliendi, nõukogude spiooni Rudolf Abeli, surmanuhtlusest päästa. Advokaat teeb seda Ameerika rahva suureks meelehärmiks, sest „õigusriiklik õigusemõistmine pidi ette nägema“ spiooni saatmise elektritoolile! Nii filmis kui tegelikkuses seda ei juhtunud! 

 

Miks? 

 

Kes tähelepanelikult filmi vaatas, nägi et peale „õigusriikliku“ vandekohtu poolt spiooni kõigis kolmes episoodis süüditunnistamist jäi kohtunikule vaid formaalne ülesanne langetada süüdimõistev otsus, mille osas 90% ameeriklastest eeldas surmanuhtlust! Nagu algselt kohtuniku hoiakust nähtus, siis oleks kohtunik otsuse ka taoliselt langetanud.

Kohtuniku nõupidamisetoa saladus?

 

 

Selle asemel, et „õigusriigis“ eksisteerivat erapooletust ja kohtuniku nõupidamisetoa saladust mitte rikkuvalt otsus ära oodata, läheb aga advokaat Donovan kohtuniku juurde koju (ta tunneb teda ja tema naist ka isiklikult!) ning asub kohtunikku vahetult süüdimõistva otsuse tegemise eelselt mõjutama! Minu arvates pole oluline see, millised „geniaalsed põhjendused“ advokaat esitas, kuigi need olid filmis kenasti argumenteeritud ja esitatud väliselt Ameerika ja inimlikkuse huvides. 

 

Märkimisväärne on asjaolu, et advokaat Donovan räägib/veenab/mõjutab just selles kriminaalmenetluses kohe lähiajal otsust tegeva kohtunikuga ja kohtuniku kodus otsesõnu, et tema kliendi R. Abeli karistus ei peaks olema surmanuhtlus! Ta püüab kohtunikku suunata tegema otsust nii nagu advokaat tahab! Seejuures osutab advokaat Donovan kohtunikule ja tema abikaasale teene (väliselt küll viisakuse ja formaalsusena), hoides käes kohtuniku ja naise joogiklaase ajal, kui kohtunik tegeles oma lipsu paika seadmisega jne. 

 

 

Milline oli advokaadi poolt sõnalise mõjutamise ja samuti nn. viisakustena teenete osutamise tulemus? 

 

Advokaadil õnnestus kohtuniku kodus saavutada kohtunikuga „vaimne side“ ja kohtunik tegigi otsuse teistmoodi kui Ameerika rahvas oli algselt oodanud ning teistmoodi kui oli kohtuniku algsest hoiakust võimalik eeldada! Kohtunik tegi otsuse täpselt nii nagu oli advokaat kohtunikule ettepaneku/mõjutuse teinud, st nii nagu advokaat oli mõjutanud/selgitanud (formaalselt „kohtuniku nõupidamisetoas olles“). 

 

Kas kohtunik või advokaat sai sellest mõjutustegevusest ning advokaadi/kliendi kasuks otsustamisest isiklikku kasu? 

 

Kindlasti sai advokaat Donovan kasu oma kliendile kui ka endale või oma büroole, sest nagu nähtub tema edaspidisest elust oli tema ka väga paljude järgnevate spioonide vahetamise vahendaja. Muidugi sai põhilise kasu klient, aga see teema huvitas ka advokaati nii emotsionaalselt kui ka materiaalselt, sest ta sai sellest nii materiaalset kui mittemateriaalset kasu ja  kuulsust? 

 

 

Kas toimingupiirangu rikkumise koosseis on täidetud ka kohtuniku suhtes, kui ta advokaadiga heades isiklikes perekondlikes suhetes olles omab advokaadiga nii varasemat kui hilisemat jätkuvat head suhet? 
 
Kas kohtunik ei oleks pidanud peale taolist advokaadi mõjutustegevust antud protsessist taanduma?

 

 

Eestis kehtivate toimingupiirangu rikkumisega seonduvate õigusaktide tõlgendusest lähtuvalt polegi ju oluline kas ja kes otsest kasu saab. Piisab vaid eeldusest, et kunagi saab kasu või et oli isiklik-perekondlik suhe, mistõttu oli hea suhte jätkamisel ju vaimne side ja ka kasu olemas!  

 

 

Kuidas käsitleda antud olukorda Eesti tingimustes? 

 

Tänase käsitluse kohaselt lisaks sellele, et kohtunik oleks pidanud taanduma, oleks kohtunik Eesti tingimustes toime pannud veel ka selle müstilise toimingupiirangu rikkumise ja/või sai advokaadilt taolise teene läbi tasuta/teenena altkäemaksu, sest peale advokaadi poolt teene osutamist ja kohtuniku mõjutamist tegi kohtunik just täpselt niisuguse otsuse nagu advokaat mõjutas/selgitas/soovis. Tundub absurdne konstruktsioon aga tänases Eestis tegelik reaalsus.  

 

Kas Eestis on tegemist korruptsiooni paranoiaga ! 

 

Üle 25 aasta tegutsenud juristina püüan ikkagi veel mõtelda positiivselt! Nii Ameerikas kui ka näiteks Saksamaal, kus olen samuti viibinud paljudel kohtuistungitel, oman häid kolleege ja koostööpartnereid,  olen enamusel juhtudel kogenud advokaadi ja kohtuniku vahel sõbralikke ning mõistlikke suhteid! Mida tähendavad mõistlikud suhted? Seda, et ei kohtalõputut „paranoiat“, kahtlustamist, et advokaat mõjutab kuidagi, kas suhtlemise või „vaimse sideme“ või mistahes teene osutamisega!

Kohtunikuga suhtlemine välisriikide praktikas?

 

Mind kui välismaalast on näiteks Saksamaal ja ka mitmetes teistes riikides korduvalt peale kohtuistungit koos kohaliku advokaadiga kutsutud kohtuniku poolt oma kabinetti „kohvi jooma“ ! Seda on tehtud avalikult ja mitte avalikult, kohe peale kohtuistungit, nii et seda on paljudel juhtudel kuulnud ka teise poole advokaat või prokurör. Ma pole kunagi kohanud olukorda, kus teise poole advokaat või prokurör leiaks, et see olukord või kohtuniku hea suhe teise poole advokaadiga tekitaks kuidagi kahtlusi kohtuniku erapooletuses või professionaalsuses!  

 

Loomulikult oli kohtuniku eesmärk lihtsalt suhelda teise riigi kolleegiga, rääkida õigussüsteemist, kohtupraktikast ning tavaliselt kingitakse kohtunikule mingi Eesti riigiga seotud suveniiri/pisiasi. Kas Saksamaa kolleegile tekkis või võis tekkida taolisest suhtlemisest mingit kasu/mõju! Eesti tänase korruptsiooni etaloni järgi kindlasti tekkis!          

 

Kas korruptsiooni pendel liigub teise äärmusse! 

 

Eestis ei olnud veel 10 – 15 aastat tagasi taolist paranoiat nagu me kohtame praegu! Täna on meil ümberringi „kõikjal“ korruptandid ehk siis „rahvavaenlased“ jne. Me oleme iseseisvad olnud juba üle 25 aasta  aga iga nädal kuuleme muudkui et ikka ja jälle on meie ümber korruptsioon, korruptsioon ! 

 

Milles siis on probleem, et me ei ole suutnud ca. 25 aastaga miskit ära teha? Kas tegelikkuses ei ole antud korruptsiooni pideva otsimise ja „pideva leidmise“ taga mitte soov kellelegi jälle „ära teha“, kedagi kohe viivitamatult ja vähimate kahtluste ilmnemisel kohe vangi panna, ajakirjanduses ilma kohtumõistmiseta täielikult „sopaga üle valada“. Isegi kui keegi, juba ette süüdimõistetud korruptant-rahvavaenlane, „juhuslikult“ õigeks mõistetakse (näiteks A. Suvorovi kriminaalasi) , siis on vajalik ajakirjanduse kaudu isiku mustamiseks tegeleda veel n-ö jätkutegevusega, „rahvavaenlase tiitli kinnistamiseks“, esitades ajakirjanduses erinevaid pealtkuulamise lõike, sõltumata sellest kas need on tekstist välja rebitud või mitte!  Taoline olukord peaks selgelt meenutama mitmeid eelmise riigikorra teatud perioode, aga „kes seda ajalugu ikka tahab enam mäletada“.  

 

Ajalugu: tõendite kadumine ja mõjutamine

 

Ajaloost on kõigile teada J.F. Kennedy tapmine ja seniajani tapjate mitteleidmine aga väga vähesed teavad seda, milline „triangel“ käis ka tookord, tapmisele järgnevatel aastatel. Jim Garrison, Luisiana osariigi New Orleansi piirkonna peaprokurör oli üks neist kes alates 1966 aastast hakkas uuesti tegelema Kennedy tapmise asjaolude väljaselgitamisega (eelnevalt oli nn. Warreni komisjon jne tegelenud aga polnud kuhugi jõudnud). Garrisson jõudis oma menetlusega isegi kohtusse kuigi vahepeal püüti teda igat moodi mõjutada, temalt varastati ära suur hulk olulisi tõendeid jne., lisaks püüti Garrisoni  menetlusest kõrvaldada. 1971  aastal “konstrueeriti” temale isegi altkäemaksu süüdistus, mille tulemusena prokurör paigutati algselt isegi vanglasse. Kuigi 1973 aastal „kukkusid“ kõik Garrissoni vastu esitatud süüdistused kokku on ka eelviidatud näitest näha, et isikute kõrvaldamine, altkäemaksu ja muude taoliste süüdistuste otsimine, leidmine  on „klassika“ ja Kennedy tapmise organiseerijad on senini tuvastamata !

 

Kuna tegemist on laiema aruteluga ning soovin teemat põhjalikult käsitleda, siis avaldan postitusele järje 22.05.2020.
