„Spioonide sild“, altkäemaks ja toimingupiirangud Eesti Vabariigis (osa 3)

Vandeadvokaat Olev Kuklase arutleb toimingupiirangute ja õigusriigi Eesti Vabariigis. Postitus on jagatud kolmeks osas osa 1 on kättesaadav SIIN ning osa 2 on kättesaadav SIIN.

Kas tõesti pole enam olemas professionaale, on ainult korruptandid/rahvavaenlased ? 

 

Me kõik oleme inimesed ja samal ajal oma valdkonna professionaalid. Kas näiteks prokuratuur, töötades nn. kinnises kohtumaja tsoonis, avatud koridori peal koos kohtunikega, ei tekita „vaimset sidet“ ja kuidagi ei mõjutata kohtunikke! Kas olukord on advokaatidega võrdne ja kas advokaadid võivad ka sinna kohtumaja kinnisesse tsooni minna kohtunikuga asju arutama ? Kas probleem on eetikas, erapooletuses, ebaprofessionaalsuses või selles kuulsas toimingupiirangu rikkumise kahtluses või hoopis tasuta altkäemaksus? Kohtunike ja prokuröride ühisest kinnisest tsoonist samas kohtumajas on palju räägitud, aga mingil põhjusel ei taheta seda mitte kuidagi lahti seletada, seda muuta ja see on ka tõenäoliseks põhjuseks, miks ei ole võimalik neid nn. toimingupiirangu reegleid täpsemalt paika panna, sest need võivad „puu teise otsaga lüüa“! 

 

Mistahes justiitsametnike ühised üritused võivad osutuda korruptsiooni ilminguteks!  

 

Täna ei julge paljud kohtunikud minna isegi mitte justiitsasutuste ühisele jõulupeole, rääkimata muudest üritustest, sest mine tea kuidas võidakse „mõjutada“, kuna selgeid suhtlemise ja toimingupiirangu reegleid ju pole! Tartu justiitsasutuste viimase jõulupeo eelselt kostus väga mitmete Toomemäel asuvate juristide suust suurt nõutust selles, et kuidas julgevad kohtunikud, prokurörid, advokaadid veel peale oktoobri lõpus toimunud sündmusi ühist jõulupidu korraldada! Kogu olukord ja reeglid on ju ebaselged ning kes teab, kes on järgmisena sihikul. Neil oli õigus, aga osavõturahad olid kohtunike, prokuröride, advokaatide poolt juba makstud ning makstud üritust korraldava kohtuniku isiklikule arvele !

Hiljuti oli ka Tallinnas arutelul olukord, kus advokaat oli peale ühist justiitsasutuste pidu viis oma autoga tasuta koju kohtunikud, kes olid piduliku ühisürituse olukorras mõneti alkoholi tarvitanud. Kohtunike elukohad ei asunud advokaadi kojusõidutee vahetus läheduses, mistõttu pidi ta kohtunikud spetsiaalselt koju viima. Advokaadil ja tasuta koju sõidutatud kahel kohtunikul oli varem ja on jätkuvalt ühiseid menetlusi, seega näilikult võib koheselt järeldada, et isiklik kasu on/oli kõigil ju „mängus“ ja teenus osutati tasuta altkäemaksuna ! Hoitagu veel selle eest kui advokaat julgeb (analoogselt Donovaniga) minna kohtunikele koju mingeid tööasju selgitama või võimalikku „teistsugust“ karistuse lahendust pakkuma! On selge, et see advokaat oli ka varasemalt/korduvalt samamoodi toiminud. Kas asume nüüd kohe kahtlema selles, et need kolm samas autos sõitnud juristi ei suuda erapooletust hoida, sest formaalselt on kõik Eestis kehtivad toimingupiirangu rikkumise elemendid „vist“ täidetud !            

Toimingupiirangud Kuklase & Partnerid

 
Nende nn. toimingupiirangute „udune olukord“ kestab juba aastaid ja mitte midagi ei muutu! 

Õiguskantsleri poolt Riigikogus ja ka mitmel juhul hiljem esitatu tekitab palju küsimusi, aga on kummaline, et tegelikkuses kestab taoline „udune olukord“ juba aastaid ja mitte midagi ei muutu, selgust saada pole võimalik! Prokuratuuri poolt viidatu, et toimingupiirangu rikkumine tähendab tegutsemist enda isiklike huvide mõjul näitab, et advokaat Donovan ja ka kohtunik otseselt rikkusid toimingupiirangute nõuet! 

Prokuratuuri poolt avalikkusele esitatu, et arst rikub toimingupiirangut siis, kui ta kirjutab oma värvipimedale pojale juhilubade tarvis ebaõige tervisetõendi välja selleks, et poeg teda suvilasse sõidutada saaks, on aga väga raskesti mõistetav? Tegemist võib olla toimingupiirangu rikkumisega, aga minu arvates on antud näite puhul tegemist tavalise võltsimisega!  

 

Kas justiitsministeeriumi ja prokuratuuri poolt soovitakse tegelikkuses ennetada, vähendada korruptsiooni, altkäemaksude, toimingupiiragute rikkumisega seotud juhtumeid või tegeldakse hoopis oma „tubli töö „ näitamisega” ? 

 

Kui vaadata mõned aastad tagasi siis tegelikkuses toimus vaid nö. laus-süüdimõistmine, väga üksikute eranditega. Üldiselt ei julgenud keegi isegi mitte sõna võtta sellel teemal, sest muidu võidi ka teda ajakirjanduses või kus iganes süüdistada „kaasa jooksmises või mahitamises “ ! Enamus inimesi kelle osas taoline korruptsioonikahtlus tekkis või tekitati olid algselt kimbatuses, aga kui nad olid meedias avalikult „sopaga üle valatud“  siis 95 %  lõid käega ja ei hakanud enam tõde taga ajama, sest keda see tõde peale taolist „sopaga üle valamist“ enam huvitab, mitte keegi nagunii enam selle „pidalitõbisest korruptandiga“ väga suhelda ei taha ! Suhted „hinnati ümber! 

 

Korruptsioonipendel liikus aga muudkui „sügavamale“!  

 

Nüüd paari viimase aasta jooksul on aga paljudel inimestel „silmad avanenud“ ! Paljud julgevad isegi sellel teemal rääkida, julgevad nende „pidalitõbistega“ suhelda!  

On ilmunud juba mitmeid raamatuid (“Hea ment“, „Jälitatav“), millede ilmumise alguses kuulsin mitmelt prokurörilt eriti halvustavaid hinnanguid mitte ainult raamatu autorite, vaid ka inimeste kohta kes julgesid meie õiguskaitseorganite laitmatus tegevuses kahelda! Kahtlejate osas kasutati mitmeid aastaid sõimusõnana savisaarlane või kesik-kohuke. Nüüd, peale Savisaare lahkumist, saavad need isikud enamusel juhtudel endale EKRE-lase sildi, kuigi isikud pole ühegi erakonna ja ka kunagise Kommunistliku Parteiga olnud seotud! EKRE enda väljendit „süvariigist“ on püütud igal tasemel ironiseerida.   

Ka esimese ja teise astme kohtunikud on viimastel aastatel julgenud taolistes asjades teha otsustusi, mis astuvad vastu tegelikkuses kontrollimatule jälitustegevusele ja alusetusele korruptsiooniga sildistamisele (A.Suvorov; V.Semilarski, Pärnu volikogu liige A.Kalmeri (RK otsus 08.05.2020) menetlustes. Lisaks on nüüd julgenud/soovinud sõna kaasa rääkida ka paljud meie riigi loomisel olnud isikud! Üks viimaseid väga tähelepanuväärseid artikleid oli meie ühe põhiseaduse looja Jüri Adamsi  07.03.2020 Postimees ilmunu SIIN ( https://leht.postimees.ee/6916538/altkaemaks-meie-oigusruumis )

 

Jüri Adams kirjutab: “Altkäemaksu võtjatega tegelemise traditsiooniline meetod on olnud järgmine: võtja maine omandanule tehakse provokatsioon, antakse üle raha, mis on kuidagi märgitud või mille numbrid on teada. Kõrgel positsioonil olijate puhul ei ole see olnud võimalik.”

 

Uus ajastu altkäemaksuasjades algas pärast Teist maailmasõda, kui sai tehniliselt võimalikuks jutuajamisi pealt kuulata või isegi filmida. 

 

Ajakirjanduses on esitatud ka küsimus, kas kõik see tasus ennast ära. Kas ei oleks saanud teisiti? Savisaare protsess kestis aastaid ning on maksma läinud tohutu hulga raha ja tööd. Sellisele küsimisele ei saa vastata päris üheselt. Arvan, et nende kohtualuste puhul ei oleks saanud teisiti. 

 

Enne Teist maailmasõda korruptsiooni eraldi juriidilise mõistena meil ei tuntud. Iseseisvuse taastamise ajal oli see aga levinud üle maailma ja nii ei saanud selle kasutusele võtmisest mööda meiegi. Avaliku ja karistusõiguse juristid hakkasid vastust otsima kahele alusküsimusele. Esiteks mõiste piirid – mida pidada korruptsiooniks, mida mitte. Teiseks, kuidas korruptsiooni defineerida. Mõlemad katsed kukkusid paraku läbi. «Korruptiivse teo» paragrahvide asjad põrusid ridamisi, kuna kaitsjad nõudsid, et süüdistus peab tõendama tahtluse olemasolu. Teistes asjades aga ei suudetud tõendada, et süüdistatav tegutses isikliku kasu saamise eesmärgil.

 

Edasi läks hullemaks. Kui esimesed kümme uue iseseisvuse aastat pendeldas «korruptsioonivõitluse» poliitika kahe tegevusmeetodi – ennetamise ja tagajärgedele reageerimise – vahel, siis millalgi kadus ärahoidmine kui eraldi eesmärk hoopiski ning eesmärgi pidi saavutama suure karistusega heidutamine.

 

Jüri Adams tõstatab väga olulise, kui mitte kõige olulisema küsimuse: milline on korruptsiooniga tegelemisel justiitsministeeriumi ja prokuratuuri tegevuse eesmärk! Väliselt väidetakse, et tegeldakse korruptsiooni ennetamisega, tegelikkuses sellega ei tegelda ! 

 

Kui ühiskond või riigiasutused püüavad vähendada hädade ja pahede hulka või tagajärgi, siis võetakse kasutusele mingeid ennetavaid, suunavaid ja toetavaid meetmeid.

 

Jüri Adams jätkab:…“ Mind närib kahtlus, et mingil ajal hakkasid otsuseid tegema ja poliitikat kujundama inimesed, kes ei saanud aru, et väljend «võitlus korruptsiooni vastu» on vaid keeleline kujund, mitte aga tegevusjuhis. Millal ja kuidas kõne all olev muutus toimus? Selle kohta ei oska ma midagi kindlat öelda. Oskan vaid dateerida, et minu teadvusesse jõudis see, et puhuvad uued tuuled, sel ajal, kui alates 2003. aastast oli justiitsminister Res Publicasse kuulunud Ken-Marti Vaher ning hakkasid kostma jutud rohkematest ja karmimatest karistustest. Hoopis olulisem oli, et peaaegu midagi ei olnud enam kuulda korruptsiooni ennetamisest ja ärahoidmisest. Pean aga tunnistama, et ma ei tea, kas või mil määral oli see tookordne pööre seotud temaga.

 

Kuid vahepeal unustatu tuleb ikka tagasi. Alates umbes aastast 2014 on justiitsministeeriumis saanud kombeks rääkida «korruptsiooni ennetamisest». Mulle küll ei tundu, et selle taga oleks suurt midagi enamat kui ilusad sõnad. Justiitsministeerium ei ole juba ammu enam superministeerium ja nende ametnike sõnad ei lähe kellelegi korda.

 

Nagu juba eelpool sai viidatud, ka sellele 24.10.2019 Riigikogus toimunud arutelule, siis reaalsuses oli seal toimunud diskussioonist näha, et kõrgete ministeeriumi ametnikel pole vaja muretseda, muretseda on vaja vaid õigussüsteemis töötavatel isikutel va. prokuratuuri töötajatel ja ennetusega tegeldakse jätkuvalt vaid sõnades, sest niikaua kui ei ole toimingupiirangutega seotud probleemides selgust, ei ole ka võimalik midagi ennetada!

Prokuratuuri arvates saab selles segases olukorras selgust vaid läbi inimkatsete ehk siis saadame kohtusse ja olukord on nagu jalgpallis, kui meeskond võidab siis olid head jalgpallurid, kui kaotab siis oli kehva treener! Ehk teisisõnu kui läheb süüdi siis oli prokuratuur „tubli“! Kui kohtunik julgeb õigeks mõista, siis keeras kohtunik asja „kihva“!  

Kas kokkuvõte on see, et olukord on lootusetu! Ei ole! 

Kui ühiskonnas tekib kriitiline mass inimestest, kes milleski julgevad vahel ka kahelda, kui ka prokuratuuri enda tegevuse üle hakatakse tegelikkuses järelevalvet tegema, kui ka prokuröride enda poolt toimepandud seaduserikkumisi hakkab erapooletu organ üle vaatama ja hinnangu andmiseks kohtusse saatma, siis on meil lootust õigusriigiks saamisel! 

On fakt, et 90 % kriminaalasjadest ei jõuagi üldmenetluse kohtulahendini, rääkimata ringkonnakohtusse või Riigikohtusse ja seetõttu ei tasu loota, et prokuratuuri tegevust kontrollib või õigust mõistab kohus, sest 90 % inimestest ei jõua ei mentaalselt ega majanduslikult sellele aastaid kestavale prokuratuuri survele vastu vaielda ja asjad lõpevad enne kui need kohtusse jõuavad! Teisalt on meile kõigile ka arusaadav, et isegi kui asi jõuab kohtusse, siis on ka kohtunik ainult inimene (oma tööalaste ja isiklike probleemide sasipuntras) ja suur hulk kuritegusid ning menetlusi on eluaegse ameti ja konkreetse kuupalgaga kohtuniku jaoks rutiin. 

 

Lõpetuseks !  Vabandan, et sai nii pikk postitus aga loodan, et ülalmärgitud teemadel on Eestis siiski olemas ka neid inimesi, kes on nõus nendel teemadel ka avalikult kaasa mõtlema, kes julgevad midagi ütelda/kommenteerida, vaatamata sellele, et sellest võib tekkida “palju pahandust”!
